Terms of Service
Free AI Perks Terms of Service
Service URL: https://getaiperks.com
Plain-English summary (not legal advice)
- What you buy: access to curated information and guides (from third parties and other data sources) about third‑party AI/cloud perks and credits (not the credits themselves).
- Who controls offers: Third‑Party Providers control eligibility, application availability, approvals, amounts, and changes.
- Auto‑renew: Subscriptions renew automatically unless you cancel before renewal.
- Free trial: A free trial is the start of a paid Subscription, not a separate free product. Unless you cancel before it ends, your payment method is charged the price shown at checkout when the trial ends, and then every billing period until you cancel. During the trial you get the Trial Perks only (the perks marked as free); Premium Perks stay locked until you pay. Pressing Unlock during a trial ends the trial and charges you straight away, and the notice shown with the button says so before you press it.
- Not using the Service does not cancel it. To stop future charges you have to cancel (Section 6.3).
- Refunds: Because access is delivered immediately, purchases are generally non‑refundable except as described in our Refund Policy.
1. Agreement
These Terms of Service ("Terms") govern your access to and use of the website and related services (the "Service"). By accessing or using the Service, you agree to these Terms.
How you accept these Terms. You accept these Terms and the Refund Policy, and acknowledge the Privacy Policy, when you create an account and again each time you sign in, by continuing past this notice on the sign‑up and sign‑in screens, which links to all three: "By continuing, you are acknowledging your agreement to our Terms of Service, Refund Policy, as well as our Privacy Policy." At Polar's checkout you also tick a required box stating: "I agree to the Terms and Refund Policy. I understand my free trial becomes a paid subscription at the price shown unless I cancel before it ends, and renews until I cancel. I request immediate access and acknowledge that I lose my right of withdrawal once access begins. No outcomes, including credits or approval, are guaranteed." Payments are also made under our payment provider's own buyer terms, which you accept at checkout (Section 2).
These Terms are part of a set of policies that also includes:
- Refund Policy:
https://getaiperks.com/en/refund-policy - Privacy Policy:
https://getaiperks.com/en/privacy-policy
2. About the operator and payments (Merchant of Record)
Free AI Perks ("we", "us") is an independent digital subscription service.
Seller of record. Subscriptions are sold through the checkout of Polar Software, Inc. ("Polar"), which acts as our online reseller and merchant of record. Polar collects the payment, issues the invoice, handles applicable sales tax/VAT, and processes cancellations and refunds under its Buyer Terms (https://polar.sh/legal/checkout-buyer-terms), which you accept at checkout. We supply the Service and its Content under these Terms.
Your card statement. Charges may appear on your card or bank statement under our payment provider's name rather than "Free AI Perks". If you see a charge you do not recognise, check the trial confirmation and receipts sent to the email address on your account, and contact us (Section 15).
For EU/EEA/UK customers: the operator is a professional service provider ("trader") for purposes of consumer protection laws.
3. Definitions
- "Content" means the databases, listings, text, guides, instructions, and other materials made available through the Service.
- "Third‑Party Providers" means the companies and providers whose perks/credits/programs may be referenced in the Content.
- "Subscription" means the paid plan that provides access to the Service for a billing period.
- "Trial Perks" means the perks marked as free in the catalogue, which are available without payment, including during a free trial.
- "Premium Perks" means every perk that is not a Trial Perk, together with its paid material (step‑by‑step claiming guides, approval information, partner codes and discounts). Premium Perks are available only with a paid Subscription or a paid one‑time purchase.
4. What the Service is (and is not)
4.1 Information access, not credits
The Service provides access to information (links, guides, eligibility hints, and curated listings) about offers that may be available from Third‑Party Providers.
We do not provide, issue, resell, guarantee, or distribute credits. Any credits, perks, discounts, or benefits are offered (if at all) by Third‑Party Providers under their own terms.
4.2 No guarantees / no outcomes
We do not guarantee that you will obtain any third‑party credits or perks. Outcomes vary based on Third‑Party Provider requirements and decisions.
4.3 Third‑Party Providers control availability and terms
Third‑Party Providers control (and may change at any time):
- whether an offer exists or continues,
- whether an application form, link, or action flow (for example, a “Continue” button) exists or is accessible,
- eligibility and verification requirements,
- approval/denial and timelines,
- amounts and usage rules,
- offer changes, suspensions, and termination.
You are responsible for reviewing and complying with Third‑Party Provider terms.
4.4 Links, action flows (for example, “Continue”), and updates
Because the Service references Third‑Party Provider sites and programs, links or application flows may sometimes be missing, broken, moved, gated behind logins, or otherwise inaccessible (for example, a provider may remove or change an application page).
We regularly review and update our Content, but we do not guarantee that every listing, link, or application path is always current in real time. You acknowledge that you use Third‑Party Provider links and services at your own risk, and we are not responsible for third‑party access issues or changes.
5. Eligibility and account responsibility
5.1 Age
You must be at least 18 years old to use the Service.
5.2 Account registration and security
You must provide accurate information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account.
5.3 No unauthorized sharing
You may not share your account credentials or access unless your plan explicitly allows it.
6. Subscriptions, billing, auto‑renewal, and cancellation
6.1 Billing and authorization
Pricing, billing cadence (monthly/annual), and taxes are shown at checkout. By purchasing a Subscription, you authorize Polar, our merchant of record, to charge your payment method for the initial purchase and, if applicable, renewals.
6.2 Automatic renewal
Your Subscription automatically renews at the end of each billing period unless you cancel before the renewal date/time.
6.3 How to cancel
You can cancel at any time, including during a free trial, without a phone call, a fee or a reason:
- Online, self‑serve: through the subscription management link in your account on the site or in the emails about your subscription (the Polar customer portal), or
- By email: write to support@getaiperks.com from the email address on your account. A cancellation request we receive before the trial ends or before the renewal date is honoured for that date, even if we act on it afterwards, and we will refund any charge made in the meantime. If you cannot sign in or the link does not work, email us before the charge date and we will cancel for you.
Cancel before the trial ends or before renewal to avoid the next charge. Cancelling stops future charges. It is not a refund request: your access continues until the end of the trial or of the current paid billing period, and the Subscription then ends without renewing. After cancelling online you should see the Subscription marked as cancelled on the subscription management page; if you do not, assume the cancellation did not go through and email us.
6.4 Price changes
If we change pricing, we will provide advance notice where required (typically by email). New prices apply at your next renewal after notice unless prohibited by law. You may cancel before a price change takes effect.
6.5 Payment failures
If payment fails (e.g., expired card, insufficient funds), we may suspend access until payment is successfully processed.
6.6 One‑time purchases / “Lifetime” access (if offered)
From time to time, we may offer a one‑time purchase (including an offer described as “lifetime” access). If offered, the details shown at checkout control.
- No auto‑renew: One‑time purchases do not renew automatically.
- What “lifetime” means: “Lifetime” means access for as long as the Service (or the relevant paid tier/feature set) is made available and operated by us, not for your lifetime.
- Scope: Your access and included features are the ones described at checkout for that one‑time purchase.
- Still subject to these Terms: One‑time purchases are still subject to these Terms (including acceptable use and anti‑scraping restrictions).
6.7 Automatic renewal law disclosures
We disclose material subscription terms (including pricing, renewal frequency, that the Subscription will automatically renew unless canceled, and how to cancel) before purchase and in accordance with applicable automatic renewal laws, including the U.S. Restore Online Shoppers’ Confidence Act (ROSCA) and California Business and Professions Code §17600 et seq., where applicable.
6.8 Free trials and the Unlock button
Where we offer a free trial, the following applies. A free trial is the start of a paid Subscription; Section 6.9 explains the charge when it ends.
(a) A trial includes Trial Perks only. During the trial you can use the Trial Perks and the parts of the Service we make available without payment, such as browsing the catalogue. A free trial is not paid access.
(b) Premium Perks stay locked for the whole trial. Premium Perks are not included in the free trial. Their step‑by‑step claiming guides, approval information, partner codes and discounts remain locked until you pay, either by pressing the Unlock button (paragraph (d)) or when the trial ends and your paid Subscription starts (paragraph (f)). Starting a trial does not entitle you to any Premium Perk free of charge.
(c) A payment method is required. Starting a trial requires a valid payment method. Nothing is charged while the trial runs. The trial length and the price that applies after it are shown before you start.
(d) The Unlock button ends your trial and charges you immediately. When you open a Premium Perk during a trial, the Service shows an Unlock button (for example, "Unlock Now"). Pressing it ends your free trial at that moment and charges your payment method the full price shown, straight away, and your paid Subscription period starts from that charge. There is no further confirmation step after you press it.
(e) The warning shown with the button, and your agreement. Together with the Unlock button, and before you press it, we display a notice stating that by unlocking you agree to end your free trial now and to be charged the stated amount that day, with links to these Terms and to the Refund Policy. By pressing Unlock you confirm that you have read that notice, you agree to end your free trial early and to pay the amount shown, and you ask us to start the paid Service immediately. If you do not agree, do not press Unlock: you keep the Trial Perks for the rest of the trial.
(f) If you do not unlock. If you take no action, the trial runs for its stated length and your paid Subscription then starts automatically at the price shown, as described in Section 6.9, unless you cancel before the trial ends. Premium Perks unlock once that first payment succeeds.
(g) If the Unlock charge is declined. If your bank declines the charge, nothing is unlocked. We may offer you a separate checkout to pay instead, and continuing to that checkout ends your free trial.
(h) Cancelling a trial. You can cancel before the end of the trial using the methods in Section 6.3 and you will not be charged for the first Subscription period.
(i) One trial per account. Free trials are limited to one per account, and we may decline to offer a trial to an account that has held a Subscription before.
6.9 When a free trial ends: the charge you authorize
(a) The trial turns into a paid Subscription automatically. Unless you cancel before the trial ends, the Subscription continues automatically when the trial ends, your payment method is charged the full price of the first billing period shown at checkout at that moment, and it is charged again at the start of each billing period until you cancel. The price shown when you start the trial is the price charged when it ends, unless you are told otherwise before then. A trial lasts the number of days shown on the trial offer, counted from the moment you start it.
(b) What you are shown before you start. Before you give any payment details, the trial offer on our site shows the trial length and the price per month that applies after the trial, and the checkout page shows the amount due today (zero) and the total after the trial.
(c) Your agreement and authorization. At Polar's checkout the trial cannot start until you tick the required box quoted in Section 1, agreeing to these Terms and the Refund Policy and confirming that you understand the trial becomes a paid Subscription at the price shown unless you cancel before it ends, and renews until you cancel. The text next to the "Start trial" button then states that by pressing it you authorize Polar Software, Inc., our online reseller and merchant of record, to charge your selected payment method in the amount shown at the end of your trial period and on each subsequent billing date until you cancel, and that you may cancel at any time before the end of your trial to avoid being charged. Ticking the box and pressing the button is your agreement to these Terms, your express consent to the automatic conversion and renewal, and your authorization of those charges. Polar keeps a record of both with your order.
(d) Not using the Service does not cancel it. Not signing in, not opening any perk, or forgetting about the trial does not cancel the trial or the Subscription. The only way to stop the charge at the end of the trial is to cancel before it ends (Section 6.3).
(e) It is a charge you authorized. A charge made when a trial ends because it was not cancelled is a charge you authorized at checkout under paragraph (c) (see also Section 15.2).
6.10 Confirmations, receipts and notices
The trial end date and the amount charged afterwards are shown at checkout. Our payment provider normally emails a confirmation when a trial starts, showing when it ends and how to cancel. We email a receipt after a trial turns into a paid Subscription, after each renewal, and after you press Unlock. Price changes are notified as described in Section 6.4. These emails go to the address on your account, so keep it up to date and check your spam folder. They are a record for you; your agreement and authorization at checkout (Section 6.9) do not depend on whether you read them.
7. Digital content delivery, refunds, and EU/EEA/UK withdrawal rights
7.1 Immediate access
The Service is delivered digitally and typically provides immediate access after purchase.
Where you end a free trial early by pressing the Unlock button, you are asking us to begin immediate performance of the paid part of the Service at that moment, and delivery of the Premium Perks begins then. See Section 6.8 and, for EU/EEA/UK customers, the withdrawal section below.
7.2 Refund Policy
Refunds are governed by our Refund Policy: https://getaiperks.com/en/refund-policy
7.3 EU/EEA and UK consumers: right of withdrawal
If you are a consumer in the EU/EEA or the United Kingdom, you have a statutory right to withdraw from the contract within 14 days without giving any reason. The period starts on the day the contract is concluded.
- How to withdraw. Tell us clearly before the 14 days end, by email to support@getaiperks.com from the email address on your account. You may use the model withdrawal form in the Refund Policy, but you do not have to.
- What happens. The Subscription ends and the payments received under it are refunded within 14 days of your withdrawal, to the payment method you used.
- Immediate access. At checkout you request immediate access and acknowledge that you lose your right of withdrawal once access begins (the box quoted in Section 1). Where the Service is digital content and we have confirmed that request and acknowledgment to you by email, your right of withdrawal ends once access begins, as the law allows. Where the right does not end, for example because the law treats the Service as a service rather than digital content, you can still withdraw within the 14 days, and we may deduct an amount proportionate to the paid access already supplied up to your withdrawal. Nothing is deducted for the free trial.
- Withdrawal is different from cancelling. Cancelling (Section 6.3) stops future charges at any time. Withdrawal is the statutory right described here.
Nothing in these Terms limits mandatory statutory rights that cannot be waived, including your rights where the Service is not supplied or is not as described.
8. Acceptable use (anti‑scraping and misuse)
You agree not to:
- use bots, scripts, or scrapers to access, collect, or extract data from the Service,
- copy or systematically download Content to create a competing product,
- resell, sublicense, or redistribute access to the Service or Content,
- reverse engineer, decompile, or attempt to extract source code or databases,
- bypass access controls or security features,
- use the Service unlawfully or in a way that harms others or the Service.
9. Intellectual property and license
The Service and Content are owned by or licensed to Free AI Perks and are protected by intellectual property laws.
Limited license: Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Content for your personal or internal business use (to help you understand third‑party offers). You may not redistribute or resell the Content or access.
The license ends when your Subscription ends or if you violate these Terms.
10. Third‑party links, providers, and unauthorized advertising
10.1 Third‑party links and services
The Service may include links to Third‑Party Provider sites. We do not control third‑party sites, and your use of them is at your own risk and subject to their terms.
10.2 No affiliation or endorsement
Unless explicitly stated, we are not affiliated with, sponsored by, or endorsed by Third‑Party Providers.
10.3 Unauthorized third‑party advertising disclaimer
We do not authorize third parties to advertise our Service as providing guaranteed credits or guaranteed outcomes. Any such claims are unauthorized and may be fraudulent.
The official description of what you are purchasing is defined by the checkout page, these Terms, and the Refund Policy.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, misuse the Service (including scraping), fail to pay, or engage in suspected fraud.
Termination does not entitle you to a refund except as required by law or as described in the Refund Policy.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
Content may be incomplete or outdated due to frequent Third‑Party Provider changes.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- Liability cap: Our total liability arising out of or relating to the Service will not exceed the greater of the amount you paid for the Service in the 12 months before the event giving rise to the claim and US$100.
- No consequential damages: We will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, lost data, or failure to obtain third‑party credits/perks), even if advised of the possibility.
Nothing in these Terms limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be limited by law. Some jurisdictions do not allow certain limitations; in that case, limitations apply to the maximum extent permitted by law.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Free AI Perks and its service providers from claims arising out of your misuse of the Service, violation of these Terms, or violation of third‑party rights. This section does not apply to consumers in the EU/EEA or the UK.
15. Billing questions, unrecognised charges, and disputes
15.1 Contact support first
If you have an issue, please contact us at support@getaiperks.com so we can try to resolve it quickly.
15.2 Charges you do not recognise or did not expect
If you see a charge you do not recognise, first check whether it comes from a free trial or Subscription started on your account (Sections 6.8 and 6.9), and look for the trial confirmation and receipts in your email.
A charge made when a trial you started with your own payment method ends, or when your Subscription renews, is a charge you authorized at checkout (Section 6.9(c)), even if you did not expect it, forgot about the trial, or did not use the Service. If you believe someone else used your payment method without your permission, tell us and your bank straight away. This does not limit your rights with your bank or card issuer.
15.3 Bank/card disputes (chargebacks)
Bank/card disputes are handled by your bank/card issuer and payment processors. A dispute is not the same as a refund request under our Refund Policy, and contacting us first does not limit your right to dispute a transaction with your bank.
If a payment is refunded or reversed, the Subscription may be cancelled and access to paid features may end.
15.4 Records we keep
We and our payment providers keep records of your account and Subscription, including when you created your account and signed in, the versions of these Terms and our policies in force at those times, the box you ticked and the charge authorization you gave at checkout, the confirmations and receipts sent to you, your cancellations and refunds, and your use of the Service (for example sign‑ins and perks opened). We use these records to answer billing questions, refund requests, complaints and disputes, and we may share them with payment providers, banks, card networks, regulators or courts for that purpose. Deleting your account does not delete these records. The Privacy Policy explains what we keep and for how long.
16. Governing law and dispute resolution
16.1 Governing law
These Terms are governed by California law, without regard to conflict‑of‑law principles. This does not limit any mandatory consumer protection rights you may have under the laws of your country of residence.
16.2 Informal resolution first
Before starting arbitration or a court case, you agree to send us a written notice of the dispute by email to support@getaiperks.com, from the email address on your account or through your lawyer, describing the claim and what you want, and to allow 30 days for us to resolve it informally. We will do the same before starting proceedings against you. This does not limit your right to contact your bank or a consumer protection authority.
16.3 Arbitration and class action waiver (United States)
If you live in the United States, you and we agree that any dispute arising out of or relating to these Terms, the Service, or any charge for it, that is not resolved under Section 16.2, will be resolved by binding individual arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court. Either party may instead bring an individual claim in small claims court if it qualifies.
- No class actions. Disputes are resolved only on an individual basis. You and we each waive the right to bring or take part in a class, collective or representative action or arbitration, and an arbitrator may not consolidate the claims of different people. If this waiver is found unenforceable for a particular claim, that claim will proceed in court and not in arbitration.
- Public injunctive relief. This section does not waive your right to seek public injunctive relief in court to the extent that right cannot be waived under applicable law.
- Costs and hearing. Arbitration fees are allocated under the AAA Consumer Arbitration Rules, under which the business pays most of the costs. Hearings take place by video or in the county where you live, and the arbitrator may award any individual remedy a court could award under applicable law.
- Mass filings. If 25 or more similar demands are filed by or with the help of the same law firm or organisation, they may be administered under the AAA Mass Arbitration Supplementary Rules.
- Opt‑out. You may opt out of this Section 16.3 within 30 days after you first accept a version of these Terms that contains it, by emailing support@getaiperks.com with the subject "Arbitration opt‑out".
- Exceptions. Either party may seek injunctive relief in court for misuse of intellectual property or of the Service (Section 8).
- Scope. This Section 16.3 applies only to disputes arising after October 16th, 2026. It does not apply to consumers in the EU/EEA, the UK, or anywhere else whose mandatory law does not allow it; they may bring proceedings in the courts of the place where they live.
17. Changes, versioning, and which version applies
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date.
Version applicable to your purchase/renewal: The version of the Terms in effect at the time you place an order or when your Subscription renews governs that specific transaction. Each time you sign in you accept the version then in force. We maintain internal archives of prior versions.
18. Miscellaneous
Severability: If any provision is unenforceable, the rest remains in effect.
Entire agreement: These Terms, the Refund Policy and the Privacy Policy are the entire agreement about the Service. Polar's Buyer Terms also govern the payment itself.
Assignment: You may not assign these Terms without our consent.
Force majeure: We are not liable for events beyond our reasonable control.
Electronic communications: You consent to receive notices electronically.
